Terms and conditions of participation

Contest: 20 pairs of movie tickets for “BACKROOMS”

 

§ 1 – Organizer

The organizer of the contest is GAMERS ONLY GmbH, Josef-Dietzgen-Str. 3, 53773 Hennef (hereinafter “Organizer”). The contest is conducted via Instagram but is in no way affiliated with Instagram or Meta Platforms Ireland Limited and is neither sponsored, endorsed, nor co-organized by them. The Organizer is the sole point of contact for the contest.

 

§ 2 – Participation Period

The contest begins on June 8, 2026, at 12:00 a.m. and ends on June 15, 2026, at 11:59 p.m. (CEST). Entries received outside of this period will not be considered.

 

§ 3 – Eligibility Requirements

To enter the contest, the following requirements must be met:

• Minimum age: 16. Participants under the age of 18 must have parental or guardian consent.

• Residence in Germany, Austria, or Switzerland.

• Possession of a publicly accessible Instagram account or one that can be contacted via direct message, or provision of a valid email address for prize notification.

• Participation is free of charge and there is no obligation to purchase.

 

Employees of GAMERS ONLY GmbH and their immediate family members are not eligible to participate.

 

§ 4 – Participation

Participation is exclusively through the official Instagram channel of GAMERS ONLY GmbH. The specific requirements for participation (e.g., commenting on the contest post, tagging someone, following the account) are described in the respective contest post on Instagram.

 

Only one entry per person is permitted. Multiple entries—such as those made using multiple Instagram accounts or fake profiles—are prohibited and will result in disqualification from the contest. Instagram is not the organizer of this contest and bears no responsibility for its conduct.

 

§ 5 – Profits

Here's what you can win:

• 20 pairs of digital movie tickets for the film “BACKROOMS” (40 tickets total)

 

Tickets will be sent to the winners digitally—via email or Instagram Direct Message. A mailing address is not required. Prizes cannot be redeemed for cash, transferred, or exchanged. Showtimes and availability are subject to the schedule of the participating theater. Tickets cannot be combined with other discounts or promotions, unless otherwise specified.

 

§ 6 – Determination of the Winners

The 20 winners will be selected by a random drawing from among all valid entries after the entry period has ended. The drawing is final. The decision is final and cannot be contested.

 

§ 7 – Notification and Prize Delivery

Winners will be notified via Instagram Direct Message within 7 business days of the drawing or, if an email address was provided, via email.

 

Winners are required to respond within 14 days of being notified and provide their preferred contact method (email address or confirmation via Instagram) so that the tickets can be delivered digitally.

 

If no response is received within this period, the prize and the right to claim it will be forfeited. A replacement drawing will be held. There is no right to claim the prize at a later date. The organizer assumes no liability for undelivered or expired digital tickets resulting from incorrect contact information.

 

§ 8 – Exclusion from the Contest

The organizer reserves the right to exclude participants from the contest if:

• false or incomplete information is provided,

• Manipulation or technical aids (e.g., bots, scripts, automated services) are used to increase the chances of winning,

• fake or inactive Instagram accounts are used to participate,

• violates these Terms of Participation or Instagram’s Terms of Use, or

• there is some other compelling reason.

 

In such cases, any winnings that have already been paid out may be reclaimed.

 

§ 9 – Data Protection

The personal data processed in connection with the contest (Instagram username and/or email address) will be used exclusively for the purpose of conducting the contest and delivering the prize. This information will not be shared with third parties unless it is technically necessary for the administration of the contest.

 

The legal basis for the processing is Article 6(1)(b) of the GDPR (performance of a contract). The data will be deleted once the contest has been fully concluded, provided that there are no legal retention requirements to the contrary.

§ 10 – Liability

The organizer is not liable for technical malfunctions on the Instagram platform that interfere with or prevent participation in the contest, unless such malfunctions are due to willful misconduct or gross negligence on the part of GAMERS ONLY GmbH. Liability for damages resulting from the use of the prizes is limited to cases of willful misconduct and gross negligence.

 

§ 11 – Early Termination

GAMERS ONLY GmbH reserves the right to suspend or terminate the contest at any time without prior notice and without providing a reason, particularly if proper conduct of the contest cannot be guaranteed for technical or legal reasons. In such a case, no prizes will be awarded, provided that the termination was not caused by the organizer.

 

§ 12 – Governing Law

The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods. The place of performance and venue for all disputes arising out of or in connection with this contest is Hennef, to the extent permitted by law.

 

§ 13 – Miscellaneous

If any provision of these Terms and Conditions is or becomes invalid, this shall not affect the validity of the remaining provisions. Such provision shall be replaced by a valid provision that most closely approximates the economic purpose of the invalid provision.

 

These terms and conditions may be changed at any time without prior notice if necessary to ensure the proper conduct of the contest.
